This Acceptable Use Policy (“AUP”) applies to every service supplied by Fabnet Group Pty Ltd, including dedicated servers, colocation, FabDNS and any related network, IP address or support service. In this policy “you” and “account holder” mean the customer of Fabnet Group Pty Ltd and anyone the account holder allows to use the services. The purpose of this policy is to protect our customers, our network, the datacentres we operate in and the wider internet from misuse.
1. Scope and Acceptance
By ordering or using any service you accept this AUP in the same way, and at the same time, as you accept the Terms of Service. Where this policy and the Terms of Service overlap, the Terms of Service prevail.
You are responsible for all use of your services, whether by you, your staff, your customers or anyone else who gains access to them, with or without your permission. If you resell or provide access to our services to others, you must ensure they comply with this AUP and you remain liable for their conduct.
2. Prohibited Content
You must not store, publish, transmit, or provide access to any of the following on our servers or network:
- Material that is illegal under any Federal, State or Local law or regulation anywhere in the world, including material that infringes copyright, trade marks or other intellectual property rights, and commercial audio, video or music files you are not licensed to distribute.
- Child sexual abuse material, or any content that sexualises minors, in any form.
- Content that is defamatory, threatening, harassing, or that incites or promotes violence, terrorism or hatred against any person or group.
- BitTorrent trackers, seed boxes or other peer-to-peer distribution of material you do not have the right to distribute.
- Warez, including pirated software, cracks, key generators, ROMs, emulators of copyrighted systems, and material relating to phreaking, hacking, password cracking or IP spoofing, whether or not encrypted. This includes sites that provide “links to” or “how to” information about such material.
- Malware, including viruses, worms, trojans, ransomware, botnet command-and-control infrastructure, exploit kits and any software designed to gain unauthorised access to or damage systems or data.
- Phishing pages, fraudulent websites, fake login pages, or any content that impersonates another person, business or organisation in order to deceive.
3. Prohibited Activities
You must not use our services or network to:
- Access, or attempt to access, any system, network, account or data without authorisation, including by port scanning, vulnerability scanning or probing systems you do not own or have written permission to test.
- Launch, participate in or facilitate denial-of-service attacks, flooding, or any other activity intended to disrupt a system, network or service.
- Forge, spoof or otherwise falsify packet headers, source addresses, email headers or any other identifying information.
- Intercept or monitor traffic that is not addressed to you.
- Distribute, sell or otherwise deal in stolen data, credentials, credit card details or other personal information obtained without consent.
- Operate open proxies, open recursive DNS resolvers, open mail relays or any other service that can be used by third parties to conceal their identity or amplify attacks.
- Engage in any activity that exposes Fabnet Group Pty Ltd, its upstream providers or the datacentre operators to legal liability, blacklisting, or loss of network peering or reputation.
- Breach the acceptable use policies of any network, provider or datacentre that carries or hosts your traffic.
4. Email and Messaging
You must comply with the Spam Act 2003 (Cth) and any equivalent law that applies to your recipients. In particular you must not:
- Send unsolicited bulk or commercial email, SMS or instant messages, or send messages to lists purchased, rented or harvested without the express consent of every recipient.
- Send messages without accurate sender identification, or without a functioning unsubscribe facility that is honoured promptly.
- Use our services to host web pages, images, links or landing pages that are advertised in unsolicited messages sent from any network.
- Operate a mail server that permits third parties to relay mail through it.
Where email sent from our network causes an IP address or range to be listed on a blocklist, we may suspend the service responsible until the issue is resolved. The account holder is liable for any costs of delisting.
5. Network and Resource Use
Bandwidth and resource use, including the fair use conditions that apply to unmetered services, are governed by sections 3 and 4 of the Terms of Service. In addition:
- IP addresses are allocated to a specific service and remain the property of Fabnet Group Pty Ltd. You must not use, announce or route any IP address that has not been assigned to your service, and you must not reassign addresses to third parties without our agreement.
- You must not deliberately generate traffic that has no legitimate purpose other than to consume bandwidth or exhaust a resource, or to test the limits of your allowance.
- If you expect a significant change in traffic volume, contact us in advance so that your service is not shut down under the High Resource User Policy.
- You must not connect equipment to our network, or change the network configuration of a colocated device, in a way that could disrupt other customers, including running your own DHCP server, spanning-tree changes or duplicate IP or MAC addresses.
6. Your Security Responsibilities
You are responsible for the security of the operating system, applications and data on your server, whether we installed the operating system or you did. You must:
- Keep operating systems and software patched and supported, and remove services you do not need.
- Use strong, unique credentials for all accounts, protect them from disclosure, and change them if they may have been compromised.
- Maintain your own backups. As set out in the Terms of Service, data and backups remain your responsibility at all times.
- Promptly investigate and remediate any compromise of your service. If a server is compromised and is being used in breach of this policy, we may suspend or isolate it without notice until it is secured.
- Keep your contact details with us current so that we can reach you about abuse reports or security incidents.
7. Colocation Equipment
If you colocate equipment with us, in addition to the above you must:
- Only install equipment that is in safe working order, correctly rated for the power and cooling available, and mounted securely in the rack space allocated to you.
- Stay within the power draw agreed for your service and not connect additional power distribution, batteries, or any device that presents a fire, electrical or safety hazard.
- Follow the access, security and conduct rules of the datacentre operator at all times when on site, and only access the racks and equipment allocated to you.
- Not store packaging, tools, spare parts or any other items in the rack or datacentre unless agreed with us.
- Label your equipment and cabling clearly so that remote hands requests can be carried out safely and accurately.
8. Monitoring and Enforcement
We do not routinely inspect the content of customer servers or traffic. We do monitor bandwidth, network health and abuse reports, and we may investigate any suspected breach of this policy.
If we reasonably believe this AUP has been breached, we may take any action we consider appropriate, including issuing a warning, filtering or rate-limiting traffic, suspending or isolating the affected service, or cancelling the service and the account in accordance with the Terms of Service. In urgent cases, such as an ongoing attack, active malware distribution or a legal demand, we may act without prior notice. Reactivation of a suspended service is subject to the fees set out in section 9 of the Terms of Service.
We will cooperate with law enforcement agencies and comply with lawful requests and court orders, and may disclose account information where required by law. The account holder indemnifies Fabnet Group Pty Ltd against any claim, loss or cost arising from a breach of this policy, as set out in the Terms of Service.
9. Reporting Abuse
If you believe a service on our network is being used in breach of this policy, please email support@fabnet.au with the IP address or domain involved, the date and time (including time zone), and copies of any relevant logs or messages with full headers. We investigate every report and respond as quickly as possible.
10. Changes to this Policy
Fabnet Group Pty Ltd may revise this Acceptable Use Policy at any time by publishing the updated version on this page. Continued use of the services after a change is published constitutes acceptance of the revised policy.
